Too bad blue isn't a very offensive color by design. This sound much more like a black or maybe red card. I bet the Overseer watches a lot of matches from the sidelines.

a 3/3 flier for 4 mana sucks enough on its own so why give it a draw back...

Why is there so much hate on my flying drone friends?
Sure, its strictly worse the Phantom Monster. But Phantom Monster never got reprinted past 5th ed.
After Hoverguard Observer, there wasnt an uncommon CMC 4 flyer with power 3 or greater until Lorwyn (Ethereal Whiskergill)
The first card printed strictly better then it was Voyager Drake.
But lets talk limited (as I feel discussing its use for competetive constructed is pointless)
The drake is part of Zendikar block, some of the fastest paced limited seen to MAN! A 3/3 flyer for 2UU is just too inflexible in this format, forcing me to have a strong commitment to blue and missing out on some powerful cheap creatures and removal from the other colours. You are either going to play it in a 2 or 3 colour beatdown deck as a 3U 3/3 flyer(to fly over what your small ground troops can no longer push through), or in a mono-blue deck which gives it the added flexibility of being a game breaker. If you are not working around the Drake you could easily find yourself sidelining it , despite the fact that its " strictly" the best 4 CMC 3/3 flyer.
Where as in Mirrodin limited (a much slower format) I could be sure my mono blue artifact deck with the observer would be swinging for 3 time and time again(atleast 3, since equipment was abundant) without too much worry of losing a to a damage race. And if im using one 3/3 hoverguard for 2UU, then im definitly going to be using his other blue friends which have various bounce mechanics which compliment that " so fat it cant block " flyer. Having so many powerful artifacts going around also makes it alot easier to make the commiment of 2UU early in a draft pick. I would have no problem taking it first if my pack was void of ace removal or bombtastic bombs.
