I don't see how his ability is a downside.

Enchant or equip the snake with something that is a threat to your opponent, and attack. If your opponent taps two of his mana to keep it from flying, you may potentially have closed his ability to cast any instants or activated abilities allowing you to activate something else without worry.

He's got a pretty good body/cmc ratio for a blue creature without the flying. He certainly isnt bad for a common.

The only good thing about this card are the mind games it plays on the opponent...

It's fine for Limited, but terrible in contructed. What deck would want a 2/3 french vanilla flier for three, let alone one that can be forced to the ground? I'll stick with Serendib Efreet or Sea Drake. If playing Pauper, I'd still prefer Illusionary Servant, or even Cloud Elemental.

This is meant to tap the opponent out, not be a powerful creature. Blue likes when the opponent has no resources left to answer for Mana Leak.
