overcost? this isn't. it's perfect for control where you don't wont to lose your creatures and you dont want opponant to creatures... and besides that you have mana enough. i think im gonna buy it^^

Often used in Recurring Nightmare/Survival of the Fittest when you can just repeatedly replay this card from the grave to sac and kill small creatures. CounterPhoenix was also a popular deck.
Don't forget, the cost to play and retrieve the Phoenix are separated. You only use it when there are a lot of creatures to kill. You won't waste mana getting it back if there's only a few creatures, which your other burn spells usually handles well.
Besides, this is a creature, it can attack just like every other.

Martyr's Bond with guy has won me a few game as a recurring 2 kill spell that killed indestructible as well, ah good times.
